1. General - Unless otherwise stated, all orders are expressly subject to these Terms and Conditions.
  2. Payment - All transactions are handled through credit card payment, Visa/MC/Amex/Disc. For Net 30 privileges, please contact us for a credit application. Once credit applications are received, please allow 7-10 business days for completion and final credit consideration.
  3. Pricing - Published prices and our Terms and Conditions of Sale are subject to change without notice. Prices posted on our website do not include applicable sales taxes or shipping and handling.
  4. Transportation & Charges - Orders will ship within 2 business days after receipt of payment, via the method chosen by the customer at time of check out. Orders of $250 or more, within the continental United States only, will be shipped freight prepaid and allowed, via the most economical mode of transportation.
    All merchandise shipped to a destination in the continental United States are usually shipped via UPS or in some cases, via common carrier. There are additional fees for shipments to Alaska, Guam, Hawaii, and Puerto Rico. Please contact us first for a shipping quote if the final destination is to one of those 4 locations. Some items require additional handling and packaging; and in those cases, a small fee will be included in the shipping cost.
  5. Damage Claims - We will not be held responsible for any shipping damages, destruction, or loss of any kind occurring after delivery to the carrier from our facility. If you should receive an item(s) damaged in shipping, you MUST notify us within 24 hours of receipt of the package at sales@breakerking.com. It is your responsibility to retain all packaging and the original box the material arrived in, along with the original tracking sticker in place. Item(s) arriving damaged via common carrier, must be notated as damaged on the drivers' bill of lading at time of delivery. We will handle the filing of the damage goods claims immediately after your notification.
  6. Warranty - Breaker King warrants that obsolete and used/tested products sold will provide satisfactory performance for a period of twelve (12) months from the date of shipment. In the event a product fails to perform throughout the warranty period, you must notify us via email at sales@breakerking.com within three (3) business days of the discovery of defect. We will remedy the failure by repair or at seller's option, by replacement of the defective product. All repairs and replacements will be F.O.B. seller's facility. Repair or replacement of defective products will only be offered as a remedy, if in fact the product in question has been stored, installed, put in service and maintained in strict accordance with the manufacturer's instructions and standard practices of the industry. Warranty does not apply to products damaged by common carrier or customer. Broken items and other physical damage to products is not evidence of a product defect. Breaker King is not a factory authorized distributor of Cutler-Hammer/Eaton, Schneider Electric, General Electric and Siemens products. All new breakers and other related products are sold strictly as surplus material and are covered by the Breaker King one-year replacement warranty. These warranties do not include reimbursement for labor to remove, transport, gain access to, install or any other expenses incurred in connection with product repair or replacement. Seller makes no warranties, express or implied, including any warranties or merchantability or fitness. Manufacturers' warranties and testing lab warranties will be exercised by seller strictly as set forth.
  7. Returns - Only new products in original intact packaging may be returned within 30 days from the date of purchase. You MUST email us at sales@breakerking.com for a return authorization prior to shipping the merchandise. A 25 percent return processing charge will be applied to all returns. All returns must be sent via United Parcel Service (UPS) and must be properly packaged according to UPS guidelines as described at www.ups.com. No credit will be issued for return freight expenses or on merchandise received damaged in shipping.
